摘要
刑法解释与刑法修改理性的冲突与消解是刑法完善重要的基础性理论问题,也是刑法法治理性实现的关键.刑法解释与刑法修改理性的冲突,是在价值理性、对象理性和方法理性这三个不同维度之上产生的.其冲突的形式主要包括抽象式、立法式的刑法解释模式与刑法条文明确性的冲突,刑法解释活化立法具有滞后性与刑法立法预见有限性的冲突,修正刑法立法规定的刑法解释与刑法立法的冲突.刑法解释与刑法修改理性冲突消解的进路,应遵循罪刑法定原则之下的法益保护原则,适用刑法解释适用优先规则、刑法解释必须用尽规则以及刑法解释权限指示规则.
The conflict and resolution of criminal law interpretation and criminal law revision rationality is an important basic theoretical problem of the perfection of the criminal law,and also the key to the rational realization of the rule of law in criminal law.The conflict between the interpretation of criminal law and the rationality of criminal law revision is based on the three dimensions of value rationality,object rationality and method rationality.The form of conflict mainly includes the following three kinds.The first is the conflict between the interpretation mode of abstract and legislative criminal law and the correctness of criminal law.The second is the conflict between the activation of criminal law legislation and the limitation of criminal legislation foresight.The third is the conflict between the interpretation of criminal law and the legislation of criminal law.The approach to the interpretation of criminal law and the resolution of the rational conflict in the amendment of criminal law should follow the rule of protection of legal interests under principle of legality,the rule of priority application of criminal law interpretation,the rule of exhaustion of criminal law interpretation and the rule of indication of jurisdiction of criminal law interpretation.
