摘要
在强化竞争政策基础地位已经成为我国发展策略的背景下,反垄断执法和公平竞争审查作为强化竞争政策的主要路径依赖,事关通过公平竞争实现高质量发展和共同富裕.现行反垄断公共执行对行政性垄断规制作为有限,公平竞争审查制度规范和优化产业政策的刚性约束不足,二者都倚重修订《反垄断法》进而完成反垄断执法体制改革和公平竞争审查制度"入法",确立国务院反垄断反不正当竞争委员会的执法职能,渐进和妥当修法可以同时实现反垄断执法赋能和公平竞争审查法治化,二者共同促进有效市场和有为政府有机结合,助力高质量发展.
In the context of strengthening the fundamental status of competition policy,which has become China's development strategy,antimonopoly enforcement and fair competition review,as the main paths to strengthen competition policy,are related to the realisation of high-quality development and common prosperity through fair competition.As the existing antimonopoly law enforcement is limited in regulating administrative monopolies,and the rigid constraints of the fair competition review system in regulating and optimising industrial policies are insufficient,both of them rely on the amendment of the Antimonopoly Law to complete the reform of the antimonopoly law enforcement system and the entry of the fair competition review system into the law,and to establish the law enforcement functions of the Antimonopoly Committee of the State Council,so that progressive and appropriate amendments can be achieved at the same time.Proper amendment of the law can simultaneously realise the empowerment of anti-monopoly law enforcement and the rule of law for fair competition review,both of which will promote the organic combination of an effective market and a competent government,and contribute to high-quality development.
