摘要
为实现“农民利益不受损”“户有所居”的政策目标,使宅基地“三权分置”改革的政策表达顺利入法,应对宅基地资格权进行科学解释。现有解释多将资格权与宅基地使用权对应,或关注其传统的成员权内容,或将其视作剩余权,均未对农户流转宅基地使用权后的居住权益作出现实关照。宅基地资格权具有居住权属性,包括居住权设定请求权。在资格权人流转宅基地后,若出现农民进城失败的情况,可以通过居住权保障其居住权益。为了保障农民户有所居,应当拓展居住权的适用范围。
In order to achieve the policy goals of "not harming the interests of farmers" and "households having a home",the policy expression of the reform of "separation of three rights" of homestead land should be smoothly incorporated into the law,and the qualification right for homestead land should be scientifically explained.Most of the existing interpretations correspond the right of eligibility to the right to use the homestead,or pay attention to the content of their traditional membership rights,or regard it as a residual right,and do not make realistic attention to the residential rights and interests of farmers after the transfer of the right to use the homestead.The right to homestead eligibility has the attribute of residency,including the right to claim residency.After the transfer of homestead,if the farmer fails to enter the city,the right of residence can be established by exercising the right of residence to guarantee the right of residence.In order to ensure that farmers have a home,the applicable scope of residence right should be expanded.
