摘要
采用文献调研与实地调研相结合、部门座谈与专家访谈相结合、系统梳理与规范分析相结合的方法,在系统梳理我国矿业权与自然保护地矛盾问题政策演进历程基础上,深入剖析矛盾背后的深层次原因,提出改进策略。研究表明,由于矿业权退出补偿、保护地划定管理、部门规划协调与信息共享等制度尚不完善,造成矿业权与保护地矛盾突出。为解决这些问题,须按照依法行政要求,推动矿业权分类处置、逐步退出;建立健全矿业权退出补偿制度,妥善解决后续问题;扎实推进保护地优化调整工作,建立健全自然保护地动态调整和差别化准入机制;建立以县域规划为基础、省市县三级统一的规划数据库平台,实现信息共享。
Through systematically summarizing the policy evolution of the contradiction between mining rights and nature reserves in China,the deep-seated reasons for the contradictions were analyzed and the improvement strategies were proposed based on literature research and field research,department discussion and expert interview,and systematic summarization and normative analysis.The research shows that,the prominent contradiction roots in the imperfect system of mining right withdrawal compensation,nature reserve delimitation and management,department planning coordination and information sharing.To solve these problems,it is necessary to classify the mining rights and withdraw gradually according to the law and administrative requirements;establish and improve the compensation system for the withdrawal of mining rights and properly solve the follow-up problems;promote the optimization and adjustment of nature reserves,establish and improve the dynamic adjustment and differentiated access mechanism of nature reserves;and construct a unified planning data platform for the three administrative levels of province,city and county,on the basis of county regional planning,so as to share the information.
