摘要
中国企业对孟加拉国的投资近年来呈增长趋势,中国企业对其投资的重要因素是孟加拉国劳动力资源充足且低廉。但孟加拉国的劳动相关法律规定及文化、宗教等与我国差异较大,孟加拉国特殊的劳动法律风险环境使得中国企业投资孟加拉国面临劳工组织法律风险、劳动安全管理法律风险、工时及休息休假法律风险、劳动争议解决法律风险以及中国籍劳动力输出的法律风险。中国企业面对这些劳动法律风险时应当做好企业合规、选择劳动法律风险较小的地区投资、做好劳动安全管理、尊重理解当地劳动人民、适应工会的角色、积极地维护自身的权益。
Chinese enterprises’ investment in Bangladesh has shown an increasing trend in recent years. The important factor for Chinese enterprises to invest is the abundant and low labor resources. However, Bangladesh’s labor-related laws, regulations, culture and religion are quite different from those in China. Bangladesh’s special labor law risk environment makes Chinese enterprises facing labor law risks, labor safety management legal risks, working hours and legal risks of rest and vacation, labor disputes resolving legal risks and the legal risks of Chinese labor output. Chinese enterprises should do a good job in corporate labor compliance, choose regional investment with less labor law risk, do a good job in labor safety management, respect the understanding of local working people, adapt to the role of trade unions, and actively protect their rights and interests.
