With the development of the times, all aspects of life are changing, and concepts are also changing. People have higher and higher requirements for living environment, space and layout, especially in todays low-carbon society. People prefer a healthy, happy and comfortable living environment. With the continuous improvement of peoples living needs, the design concept of "people-oriented" in architectural design also appears. It adopts humanized design to create a warm and pleasant atmosphere. Therefore, in the current residential building design, it is necessary to meet the needs of residents. While living needs, we should also consider the impact of the living environment on all aspects of human beings, so as to create a livable living environment for human beings. 展开更多

During the Tang Dynasty, incarcerated prisoners enjoyed various rights during their detention, including access to clothing, food, medical care, hygiene, rest, and burial arrangements.Under specific conditions, prisoners were even granted leave for family events such as funerals or weddings. The Rules for Prison Officials(Yuguanling)detailed the rights and safeguards for prisoners and set clear guidelines on the use of restraints during detention.Additionally, the Statutes on Deciding Cases(Duanyu Lü)outlined explicit penalties for judicial officials who failed to ensure prisoner rights or committed related violations.Interrogation processes adhered to strict procedural and substantive requirements, including direct questioning by judges, the avoidance of cases involving personal connections or conflicts of interest,evidence-based cross-examinations,careful investigation of circumstances, and consistent rulings across similar cases. The Tang legal code imposed comprehensive, detailed, and stringent limits on the application of coercive interrogations, specifying restrictions on tools, methods, subjects, and extent.Any breaches of these restrictions were met with severe punishments. While the concept of“human rights”did not appear in Tang legal and administrative texts, these laws and regulations embody abundant principles of people-centered governance, benevolence, and human rights concepts.Systematic examination of these ideas, values, and principles—when integrated with the Marxist perspective on human rights—can enrich China’s contemporary human rights practice, contribute to articulating China’s unique narrative on human rights, and play a role in constructing a distinctly Chinese discourse on human rights.Such efforts could provide Chinese wisdom and proposals for the advancement of human rights globally. 展开更多

The basic human rights concepts in Chinese classics mainly encompass three categories:the concept of order and freedom influenced by the worldview of the harmony between humanity and nature, the concept of human subjectivity and the source of human rights influenced by the people-oriented or benevolence-oriented values,as well as the concept of the relationship between human rights and state power guided by the outlook on life of the great unity of all under heaven(tianxia).Among them, the concept of order and freedom of the harmony between humanity and nature and modeling itself on nature is more beneficial to the stability and development of human society than the Western concept of order and freedom under“rational choice.”The norm prototype of“Do not do to others what you do not want others to do to you”formed the Article 4 of the French Declaration of the Rights of Man and of the Citizen in 1789,and the concepts of“benevolence”and“human superiority”were written into Article 1 of the Universal Declaration of Human Rights and the preamble of the Declaration of the United Nations Conference on the Human Environment, respectively, which have become the common spiritual wealth of all humankind. The ancient Chinese imperial examination system for selecting virtuous and capable people was basically consistent with the provisions on the political rights of citizens to hold public office stipulated in contemporary human rights documents, and was advanced in the world at that time. The contemporary Chinese system of“the state respects and protects human rights”is a system rooted in the Chinese historical and cultural traditions and is with the superiority of socialism. 展开更多

The Western liberal view of global governance can no longer effectively address the challenges facing the world today or respond to the demands of developing countries in the fields of human rights and development.Meanwhile, the United Nations human rights and development agenda also has its limitations.Against such a backdrop,China's path of human rights development has avoided the trap of human rights confrontation and the clash of civilizations. It has set an example of complementarity and positive interaction between human rights and development by unifying collective human rights with individual human rights and integrating the universality and particularity of human rights.Xi Jinping, general secretary of the Communist Party of China(CPC)Central Committee, delivered a speech at the 37th group study session of the Political Bureau of the CPC Central Committee on China's Path of Human Rights Development. This elevated China's human rights development to a new historical height.Practice has proved that China's concept and path of human rights in the new era have not only effectively promoted the development of its human rights cause, but also contributed Chinese wisdom to the global cause of human rights and development with a larger concept of human rights.Under the framework of the concept of building a community with a shared future for mankind, the Belt and Road Initiative, and the Global Development Initiative,China has contributed to enhancing the discourse power of developing countries in human rights and building a fairer, more just, more reasonable and more inclusive system for global human rights governance. 展开更多

Human rights are both a hallmark of progress in human civilization and a shared achievement of all civilizations.Throughout history, civilizations, including the Chinese civilization, have continuously explored fundamental questions about human life, value, and dignity, collectively shaping the foundation of global human rights civilization. On November 20,2024,the International Academic Conference on the Ideas of Human Rights in Ancient Chinese Classics was held at the Yuelu Academy of Hunan University.Attendants explored the historical origin and creative transformation of China’s human rights civilization from four dimensions, namely comparative studies of human rights civilizations in China and abroad, human rights concepts in Confucian classics and historical records, human rights concepts in Chinese philosophical and miscellaneous works, and human rights concepts in legal texts. The conference examined the historical connection between human rights concepts in ancient Chinese classics and the shared values of humanity, aiming to promote global human rights dialogue and mutual learning through civilizational exchanges.By bridging“ancient and modern,East and West,”it illuminated the civilizational foundations and Chinese wisdom underlying global human rights governance. 展开更多

In 2024,China’s human rights research has assumed a distinct“autonomy-oriented shift,”with scholars beginning to refine and construct uniquely Chinese and locally identifiable human rights concepts, categories, and discourses.Building an independent human rights knowledge system has become a core academic focus in China’s human rights research field.Upholding fundamental principles and breaking new ground are the key methodological principles for the process.China’s human rights research should be rooted in the“cultural lineage”by preserving the essence of fine traditional Chinese culture, guided by the“moral lineage”by adhering to the Marxist view on human rights, and anchored in the“Four-sphere Confidence”by upholding a distinct human rights development path,so as to define the historical coordinates and value stance of China’s independent human rights knowledge system.Meanwhile,it should maintain a high degree of openness in knowledge, theory, and methodology to address emerging rights demands and contribute to building a new global human rights governance order,so as to underscore the mission of China’s independent human rights knowledge system in the contemporary era and China’s responsibility as a major global actor.China’s human rights research should uphold the dialectical unity between the fundamental principles and innovations, and advance the systemic and theoretical interpretation of its independent human rights knowledge. 展开更多

Human rights education in primary and secondary schools is the initial and crucial phase of human rights education.Based on the normative documents formulated by the United Nations for human rights education during this phase, this paper constructs the United Nations standards for human rights education in primary and secondary schools, which include four major aspects:educational content, educational methods, reference mechanisms, and human rights concepts. They correspond respectively to the core connotations, practical pathways, institutional protections, and spiritual pursuits of human rights education in primary and secondary schools. On the basis of critically reflecting on these standards, and in reference to the United Nations standards and in accordance with China’s actual conditions, this paper proposes the“Chinese Approach”for human rights education in primary and secondary schools:first,in terms of legislation, clear legal basis should be provided;second,in terms of administration, clear goals and action guidelines should be provided;third,in terms of resource guarantee, sufficient resource support should be provided;fourth,in terms of curriculum design,it should be suitable for Chinese primary and secondary school students;fifth,in terms of evaluation mechanism,a variety of evaluation mechanisms should be constructed. 展开更多

Under the background of the continuous improvement of the overall social and economic level, people's quality of life is constantly improving, they are more in pursuit of the spiritual world, and they are more yearning for a high-quality life. The idea of humanization is based on people's actual needs, closely combining humanization with the development of modern society, so that people's needs can be effectively satisfied. After analyzing the current development situation, it is found that the humanized concept applied in landscape architecture design is relatively limited. Under the background of vigorous development of landscape architecture construction, it becomes more critical to embody the humanized concept in landscape architecture design, in order to further enrich the design connotation, strengthen people's aesthetic consciousness and effectively meet people's actual needs. Next, the article discusses the application of humanized design concept in landscape architecture design. 展开更多

The construction of a barrier-free environment contains a rich connotation of human rights protection, and is closely related to the study of human rights protection in China. With the evolution of the concept of barrier-free design and the expansion of its beneficiary groups, constructing a barrier-free environment has become a basic task that benefits all members of society and meets the public needs of all the people, with its core goal expanding from the protection of the rights of the disabled to the protection of the basic rights and interests of all members of society.Building a barrier-free environment from the perspective of the Marxist human rights concept is conducive to safeguarding the people’s right to subsistence and development, and at the same time,it satisfies their demand for the right to pursue a high-quality and better life and reflects the common vision of everyone in society fully enjoying human rights.promoting the construction of a barrier-free environment in terms of legal protection based on China’s institutional advantages can improve and innovate the country’s legislation on the construction of a barrier-free environment,so as to play an exemplary and guiding role in enhancing the international barrier-free level and enable all people to enjoy the good life created through the drive to build a barrier-free environment. 展开更多

Traditional human rights theory tends to hold that human rights should be aimed at defending public authority and that the legal issue of human rights is a matter of public law. However, the development of human rights concepts and practices is not just confined to this.A textual search shows that the term“human rights”exists widely in China’s civil judicial documents.Among the 3,412 civil judicial documents we researched, the concept of“human rights”penetrates all kinds of disputes in lawsuits, ranging from property rights, contracts, labor, and torts to marital property, which is embedded in both the claims of the parties concerned and the reasoning of judges.Human rights have become the discourse and yardstick for understanding and evaluating social behavior. The widespread use of the term“human rights”in civil judicial documents reflects at least three concepts related to human rights:first, the rights to subsistence and development are the primary basic human rights;second, the judicial protection of human rights is a bottom-line guarantee;third, the protection of human rights aims to achieve equal rights.Today, judges quote the theory of human rights in judicial judgments from time to time, evidencing that human rights have a practical function in judicial adjudication activities, and in practice this is mainly manifested in declaring righteous values and strengthening arguments with the values and ideas related to human rights, using the provisions concerning human rights in the Constitution to interpret the constitutionality, and using the principles of human rights to interpret blurred rules and rank the importance of different rights. 展开更多

What is summarized as'harmony is of paramount importance' is a most prominent philosophical approach embraced by China's Confucian culture. This is an extension of the approach summarized as 'the people are of paramount importance.' It calls for harmonious human relations, obliging one to respect others' rights and interests while protecting the rights and interests of one's own. Harmony as a philosophical approach manifests itself, in many ways, in the realm of human rights in China today. To name just a few: the country's political system of multi-party cooperation under the leadership of the Chinese Communist Party, harmony that prevails between different religions in the country, and the country's call for international dialogue and cooperation to promote the human rights cause. As a fine Chinese tradition, this philosophical approach is being carried forward. 展开更多
