However, typical events such as the administrative penalty case reveal that there are significant legal regulation blind spots in the circulation of old books on the current C2C platform. The core contradiction is reflected in three levels: First, as a special commodity, the legal attributes of the old book is not clearly defined;Second, the qualification of individual operators there are systemic gaps;Third, the platform of the second-hand trading of the regulatory problems. This systematic lack of judicial practice in the application of the law into a dilemma. To solve this institutional problem, it is necessary to build a coordinated governance framework. Specific paths include: adding special provisions for the circulation of used books at the legislative level, and establishing an exemption mechanism for small incidental transactions;implementing a hierarchical management system for platforms at the law enforcement level, and designing differentiated compliance obligations according to the scale of transactions;and perfecting the system of guiding cases at the judicial level, and clarifying the reasonable attention of content auditing. At the same time, it is recommended to build a laddered responsibility system to regulate platforms and platforms to bind users.
