The development of the industry can be roughly divided into three main stages: industry exploration period, rapid expansion period and new stage of high-quality development, and this year, cross-border e-commerce platforms have entered a new stage of high-quality development, China’s cross-border e-commerce export industry has begun to focus on the construction of comprehensive advantages in brand, channel, supply chain and marketing, etc., and is committed to achieving more comprehensive and three-dimensional development. In the face of challenges brought about by fluctuations in the global order, such as changes in demand, rising costs and declining consumer confidence, cross-border e-commerce platforms have begun to pay more attention to brand cultivation and provide merchants with one-stop foreign trade supply chain services. This article will analyze the development status and problems of cross-border e-commerce platforms, and then select SHEIN as a representative for case analysis. Finally, according to the existing problems, the development trend and countermeasures of China’s export cross-border e-commerce are proposed.展开更多

The forms of patent infringement are emerging endlessly, which not only include traditional product infringements but also involve infringements related to technological and business model innovations of e-commerce platforms. However, in real life, there are certain difficulties in regulating patent infringements in the B2B2C e-commerce model. The complexity of the entities involved in the B2B2C e-commerce model makes it hard to define liability for infringements. The B2B2C e-commerce model has become an important part of international trade. The differences in legal systems among countries and regions inevitably lead to conflicts in the application of laws in transactions. At the same time, with the rapid development of the B2B2C e-commerce model, the legal system is inevitably lagging behind, resulting in the relatively slow development of the patent supervision system. This paper tries to improve patent infringement protection from three aspects: establishing a multi-party collaborative protection mechanism, using technical means to avoid the occurrence of infringements, and establishing a cross-border dispute resolution mechanism. It also encourages all parties involved to actively fulfill their responsibilities in the B2B2C e-commerce model.展开更多
