摘要
2022年和2024年先后发布的“葛来仪报告”,用断章取义的方式解读联大第2758号决议,其核心是鼓吹所谓“台湾地位未定论”,协助台湾当局拓展所谓“国际空间”,并鼓动美国干预未来可能发生的两岸冲突。一个中国原则由两个支柱构成,即“世界上只有一个中国,台湾地区是中国领土不可分割的一部分”和“中华人民共和国政府是代表全中国的唯一合法政府”。二战后台湾回归中国不仅具有法理上的合法性,也具有程序上的完整性。联大第2758号决议并非如“葛来仪报告”所宣称的“与中国的一个中国原则毫无关系”;相反,该决议巩固了一个中国原则的第二个支柱,在逻辑上进一步完善了一个中国原则。中国学者在论证二战后台湾回归中国的法律依据时,应突出《日本投降书》对《开罗宣言》和《波茨坦公告》的法理支撑作用,着重阐释三者三位一体的内在逻辑关系。
The two"Glaser Reports"released in 2022 and 2024 selectively interpreted UN General Assembly Resolution 2758,with their core message advocating the so-called"undetermined status of Taiwan",assisting the Taiwan authorities in expanding their purported"international space",and inciting the U.S.intervention in potential future cross-Strait conflicts.One-China principle consists of two pillars,namely"There is only one China in the world,and Taiwan region is an inalienable part of China s territory"and"The Government of the People's Republic of China is the sole legitimate government representing the whole of China".After World War II,Taiwan s return to China not only has legal legitimacy but also procedural integrity.UN General Assembly Resolution 2758 is not"completely unrelated to one-China principle of China"as claimed in the Glaser Reports;on the contrary,the resolution consolidates the second pillar of one-China principle and further logically improves one-China principle.When Chinese scholars argue for the legal basis of Taiwan s return to China after World War II,they should highlight the juridical support role of The Japanese Surrender Document for the Potsdam Proclamation and The Cairo Declaration,emphasizing the intrinsic logical relationship among the three as a trinity.
