摘要
海底电缆兼具功能价值与脆弱性特征,其法律保护已成为国际社会不容忽视的监管议题。当前,对海底电缆破坏行为的法律定性仍存在较大争议,主要集中于应将其视为一般刑事犯罪、海盗还是恐怖主义。在现行国际法框架下,沿海国、船旗国及其他国家均可能援引不同法律依据和法理基础对破坏行为主张管辖权,由此可能引发管辖重叠或真空等问题。此外,为预防和减少海底电缆破坏行为,多国正推动设立海底电缆保护区。此类保护区设立的合法性及其所采取的措施对他国既有海洋权利的影响,亦成为国际法领域亟待回应的重要问题。
Submarine cables possess both functional value and inherent vulnerability,making their legal protection an increasingly unignorable regulatory issue for the international community.Currently,there remains highly controversy over the legal characterization of acts that damage submarine cables,primarily centered on whether such acts should be classified as general criminal offenses,piracy,or terrorism.Under the current framework of international law,coastal states,flag states,and other states may invoke different legal bases and jurisprudential foundations to assert jurisdiction over such damaging acts,potentially leading to issues such as overlapping or vacuums of jurisdiction.Additionally,to prevent and reduce acts of damage to submarine cables,multiple countries are promoting the establishment of submarine cable protection areas.The legitimacy of establishing such protected areas and the impact of the measures taken on the existing maritime rights of other countries have also become critical issues requiring urgent response in the field of international law.
