摘要
民事在线诉讼程序选择权是当事人在法定权限范围内,就诉讼程序运行方式及相关程序性事项依法享有的自主选择权。民事在线诉讼程序选择权是“司法为民”理念的实践,通过便利当事人司法救济和保障实质平等,彰显司法人民性。该权利本质是传统程序选择权的在线化延伸,既丰富了程序选择权体系,又契合了互联网时代诉讼主体的多元需求与发展趋势。民事在线诉讼程序选择权是程序性诉讼权利而不是实体性诉讼权利;从行为效力来看,它是程序性形成权而不是程序性请求权,表现为在线诉讼的启动、进行以及送达仅需形式审查即可成立,赋予当事人高效的程序处分能力。制度支持层面需构建程序转化机制、细化送达制度、优化当事人程序选择权的效能以及强化在线诉讼平台的便利性,以此来保障权利实效,推动“数字正义”实质化。
The right of procedural selection in civil online litigation is the autonomous right that litigants enjoy within the legal authority to select the operation mode of litigation procedures and related procedural matters in accordance with the law.The right to choose civil online litigation procedures is the core practice of the concept of"judicial service for the people",which demonstrates the people-oriented nature of the judiciary by facilitating litigants'judicial relief and ensuring substantive equality.This right is essentially an online extension of the traditional right to choose procedures,enriching the system of procedural choice rights and meeting the diverse needs and development trends of litigation subjects in the Internet era.The right of procedure selection in civil online litigation procedures is a procedural litigation right rather than a substantive litigation right;in terms of behavioral effect,it is a procedural formative right rather than a procedural claim right,which is manifested in the fact that the initiation,progress and service of online litigation only require formal review to be established,granting litigants efficient procedural creation capabilities.At the institutional support level,it is necessary to build a procedure conversion mechanism,refine the service system,optimize the effectiveness of litigants'procedural choice rights,and enhance the convenience of online litigation platforms to ensure the effectiveness of the rights and promote the substantiation of"digital justice".
