摘要
民事执行检察监督在强化法律监督职能、推动民事执行规范化、完善司法监督体系等领域具备典型意义。自2021年《人民检察院民事诉讼监督规则》颁布实施以来,我国民事执行检察监督体系逐步得到完善,但因践行时间较短,理论研究与实践经验尚显单薄,我国民事执行检察监督存在诸多问题。通过探析民事执行检察监督的立法表达与实践运用,从完善民事执行检察监督权力的规范性内容、强化调查核实权的深度运用、创造数据赋能的数字化监督环境、推进健康高效的法检工作联动机制、强化检察监督队伍的人才保障等方面优化民事执行检察监督体系,以期使民事执行检察监督更为高效科学,推进执行权运行机制的现代化发展。
Civil Procuratorial Supervision in enforcement has exemplary significance in strengthening legal oversight functions,promoting standardized civil enforcement,and improving the judicial supervision system.Since the promulgation and implementation of the“People's Procuratorate Civil Procedure Supervision Rules”in 2021,the Chinese-style civil procuratorial supervision system in enforcement has gradually been improved.However,due to its relatively short historical period of practice,theoretical research and practical experience remain insufficient,leading to numerous issues in China's civil procuratorial supervision in enforcement.By analyzing the legislative expression and practical application of civil procuratorial supervision in enforcement in Qinghai Province,this paper proposes optimizing measures such as refining the proactive content of procuratorial supervision powers,deepening the application of investigative verification authority,creating a digitally empowered supervision environment,promoting a healthy and efficient coordination mechanism between judicial and procuratorial work,and strengthening talent support for the procuratorial supervision team.The aim is to enhance the efficiency and scientific rigor of civil procuratorial supervision in enforcement,thereby advancing the modernization of the operational mechanisms of enforcement authority.
