摘要
坚持运用法治思维和法治方式,是推进反腐败追逃国际合作鲜明的特征。当前,在以《联合国反腐败公约》为核心的多边框架下,我国在反腐败追逃国际合作领域取得了“量、质、效”齐升的效果。但囿于国际情势变化,叠加各国意识形态、法律制度差异,当前我国反腐败追逃国际合作面临共识落地难、受到国家间利益博弈影响、信息壁垒多等困境。新时期我国应以习近平法治思想为指引,借助自身数字化改革的实践经验,创新“数据+法治”反腐败思维和模式,重点强化信息、利益及平台等方面的合作与共享,打好异地追诉、缺席审判和没收非法所得等追逃国际合作法治组合拳,在统筹推进国内法治和涉外法治的进程中,加快完善反腐败涉外法律法规体系,提升反腐败追逃国际合作透明度。
Adhering to the use of legal thinking and methods is a distinctive feature of promoting international cooperation in anti-corruption and apprehending fugitive.Currently,under the multilateral framework centered on United Nations Convention against Corruption,China has achieved a simultaneous progress in“quantity,quality,and effectiveness”in the field of international cooperation in anti-corruption and fugitive repatriation.However,due to changes in the international situation and differences in ideological and legal systems among countries,current international cooperation in fugitive repatriation is faced with challenges such as difficulty in implementing consensus,multiple information barriers,and slow turnover of existing resources.In the new era,China should take Xi Jinping thought on the rule of law ideology as a guide,learn from its own practical experience in digital reform,innovate the“data plus rule of law”anti-corruption thinking and model,focus on strengthening cooperation and sharing information,interests,and platforms,and play a good role in international cooperation in dealing with remote prosecution,trial in absentia,and confiscation of illegal gains.In the process of coordinating the promotion of domestic and foreign-related rule of law,China should accelerate the improvement of the anti-corruption and foreign-related legal and regulatory system,and enhance the transparency of international cooperation in anti-corruption and fugitive repatriation.
