2024年11月25日,最高人民法院发布第41批指导性案例(指导性案例230—236号)。这是最高人民法院首次发布海事审判专题指导性案例。本专题指导性案例涵盖了海上货物运输、海难救助、船舶触碰损害责任、海事赔偿责任限制基金的设立、申请承认外国法院民事判决、涉外法律适用等多个领域,为相关案件审判提供了权威、规范的裁判指引。为便于司法实践中正确理解和准确参照,本文就本专题指导性案例的编选背景、主要考虑及理解与参照应当注意的问题等做了介绍。
On November 25,2024,the Supreme People's Court released the 41st batch of guiding cases(Guiding Cases No.230-236).This marks the SPC's first issuance of thematic guiding cases on maritime adjudication.These guiding cases cover various areas,including carriage of goods by sea,maritime salvage,liability for damages caused by ship collisions,the establishment of maritime liability limitation funds,recognition of foreign civil judgments,and the application of laws in foreign-related cases.They provide authoritative and standardized adjudication guidelines for the trial of relevant cases.To facilitate correct understanding and accurate application in judicial practice,this article outlines the background of the compilation of these thematic guiding cases,the main considerations involved,and the key issues to note when understanding and referencing them.
