摘要
2021年最高人民检察院发布了《人民检察院民事诉讼监督规则》,意味着我国民事执行检察监督程序逐步确立,该程序在取得一定成效的同时也存在一些问题,比如民事执行的检察监督局限于程序监督;案件范围局限于诉讼程序案件,对于非诉案件执行较少进行监督;执行监督力度不足。通过具体探究该检察监督程序问题的形成原因,可通过优化监督方式、强化专业人才建设、增强检察监督职权效力等方式对民事执行检察监督程序进行完善。
In 2021,the Supreme People’s Procuratorate issued the Rules for Civil Litigation Supervision of the People’s Procuratorate,which means that China’s civil execution procuratorial supervision procedure is gradually established.While the procedure has achieved certain results,there are also some problems,such as the procuratorial supervision of civil execution is limited to procedural supervision;the scope of cases is limited to litigation.In procedural cases,there is less supervision on the execution of non-litigation cases;the supervision of implementation is insufficient.By specifically exploring the reasons for the formation of the procuratorial supervision procedure,the civil execution supervision procedure can be improved by optimizing the supervision method,strengthening the construction of professionals,and enhancing the effectiveness of procuratorial supervision.
