摘要
诉前检察建议是行政公益诉讼的必经和前置程序,其是否有效落实直接关涉维护公益的目的是否实现,同时也影响诉讼程序的推进与延伸,因此有必要对诉前检察建议的实效性进行审查。审视现行法规范,不论是国家层面,还是地方层面,对诉前检察建议的审查标准规定相对单薄、抽象,并呈现出审查主体的封闭性、审查对象不周延、审查内容不完整、未区分审查阶段等问题。解决诉前检察建议审查标准制度供给不足问题,须在理性分析影响因素的前提下,跳出行为审查或结果审查的逻辑怪圈,以不同阶段的程序功能、价值作用为主,构建稳定、可预期的分阶段诉前检察建议审查标准。
Procuratorial recommendations before litigation are necessary and pre-procedures for administrative public interest litigation. Whether they are effectively implemented is directly related to the achievement of the purpose of safeguarding public interest, and it also affects the advancement and extension of litigation procedures. Therefore, it is necessary to review the effectiveness of pre-litigation procuratorial recommendations. As for the current laws and regulations, whether they are at the national or local level, the review standards of pre-litigation procuratorial recommendations are relatively incomplete and abstract, and have pratical problems such as the closure of the review subject, incomprehensive review object, incomplete review content, and the lack of the distinction of review stages. To resolve the constraints of insufficient supply of the review standard system of pre-litigation procuratorial recommendations, it is necessary to break out of the logical vicious circle of behavior review or result review under the premise of rational analysis of influencing factors, and focus on the procedural functions and value effects at different stages to establish the stable, predictable and staged review standards of pre-litigation procuratorial recommendations.
