摘要
文章指出以前的历次政府机构改革之所以没能取得最后成功 ,是因为缺少法律保障。为此要解决政府机构改革的相关法律问题 ,首先要保障人大及常委会对政府机构改革有实质性决定权 ,其次应完善政府向人大及常委会提出改革方案的法律程序 ,最后应用法律形式将机构改革内容予以确定 。
The paper demonstrates the several legal questions in the reform of goverment's organs.Which include the power of determination on the instating organs of goverment,the legal procedure of goverment handing in the law sketch to the Congress of Peple's Representative and it's commission,and constituting law of govement's organs.
