摘要
"网购书被查案"之先行登记保存属于行政强制措施,具有进行实质审理的必要性。该行为的合法性认定应在明确行为性质的基础上,围绕争议焦点及其法律规范要件,从实体和程序两方面进行判断。从实体上看,被告暂时限制了原告对书籍的使用权,对原告个人利益产生了直接的、现实的影响;但个人利益的损失与可获取的加总起来的公共利益相比显得微不足道,故该限制没有逾越法律上的界限,属于正当必要。从程序上看,对原告采取先行登记保存证据的检查手段时,必须达到嫌疑事实具有一定确实程度的证据证明标准,以及符合法定期限和告知义务等要求;而现可获得的确定事实并不能排除行政行为的程序违法性。
The preservation act in advance of this case belongs to the administrative compulsory measures with the necessity of real trial.Its legitimacy identification should center on the related disputes and its legal normals on the basis of defining the behavior nature, making judgment from the substantive and procedural aspects. From the perspective of the substance, the defendant temporarily restricted the plaintiff's right to use the books, which had a direct and realistic impact on the personal interests of the plaintiff. But the loss of individual interests is insignificant compared with the public interest that can be acquired, so the restriction does not go beyond the legal boundaries and is justified. From the procedural point of view,the plaintiff must achieve a certain degree of evidence to prove the truth of the suspected facts before taking the preservation action in advance,as well as meet the statutory deadline and the requirements of the obligation to inform. However,the administrative action in this case can't be excluded from the procedural violation according to the determinable facts that can be obtained.
