摘要
从国家悖论与掠夺之手、土地集体所有权陷阱、征地补偿基准不能反映土地的相对稀缺、被征地农民保障制度缺失等方面入手,详细分析我国征地冲突困局的成因,并在对策总结中抓住最核心的土地产权问题进行着重阐释,提出实施限定范围的土地私有化改革方案,同时指出土地产权问题并非我国征地困局中惟一问题,而应该以土地产权为重点,结合其他对策实施系统的、配套的改革措施,共同化解我国征地冲突困局。最后提出政治体制改革是我国土地产权改革能否成功的前提和关键。只有进行同步的政治、经济制度改革才能实现我国城镇化进程快速发展和保护农民权益兼顾的双赢局面。
From the views of National Paradox and grabbing hand, traps of collective ownership of land, land requisition compensation benchmark does not reflect the relatively scarcity of land, lack of landless farmers and other aspects of security systems, we analyze in detail the causes of land conflict dilemma, and highlight land own- ership as the core issue from the summarizing the countermeasures. It is proposed that the reform program of land privatization should be implemented in a limited range. The land ownership issue is not the only problem in land acquisition, though it is the key point, so it should be reformed in combination with other measures as a compre- hensive system, so as to resolve land conflicts predicament. Finally, it is pointed out that the political reform is the premise and the key to decide the success of the land ownership reform. Only to synchronize the political and economic system reform can we realize a win-win situation of rapid development of China＇s urbanization process and protection of farmers＇ rights and interests.
