摘要
法官的职业伦理是在法治的价值取向下的法官的职业化过程中的衍生物,是在法治的背景下从事法官职业处理与相关当事人之间关系时所应当遵守的那些准则和规范。而新中国的法官职业是以民主为基本的理念,同时揉合了"案结事了"的职业定位而建立起来的,它缺失法治的理念,因此,我国法官职业伦理的建设应当以法治为根本的理念进行重述。
The judges＇ professional ethics are the derivatives of the rule by law, and the judges should obey the rules and norms when d judges＇ professionalization under the value of ealing with the relationship between judges and the persons concerned accordingly. However, Chinese judges＇ profession is under the basic idea of democracy and the career orientation of ＂case closed＂, and it comes short of the idea of rule by law; therefore, Chinese judges＇ professional ethics should be restated under the basic idea of rule by law.
