摘要
过多地依赖行政权力管理经济和社会事务的弊端,导致深化行政审批制度改革面临着各种挑战。因而在这种背景下,社会满意度作为衡量政府改革、市场运行、社会发展状况的重要标准,越来越引起政府、市场与社会的重视。审批制度改革的重点在于理顺权力与权利之间的关系以解决权力制约机制问题,为廉政制度建设提供发展理路、权力监督、利益协调与社会环境等条件。推动行政审批制度改革与廉政建设,应采用社会回应型的目标模式,把握权力与权利并重的核心内容,坚持以行政审批和廉政建设自身规律为导向的指导原则,采取健全法律渐进式的路径程序,其关键在于厘定公共领域的边界和满意度评价主体,培育成熟的社会和实现公民权,推进政府职能转变,寻求权力制约的途径。
To deepen the reform of administrative examination and approval system faces a variety of challenges, which are caused by the heavy reliance on the administrative authority to manage economic and social affairs. Therefore, as an important criterion for assessing government reform, market operation and social development, social satisfaction has attracted increasing attention from the government, the market and the society. The focus of administrative examination and approval system reform is to rationalize the relationship between power and rights in order to impose effective check on power and help build a good environment for the institutional construction of a clean and honest government in terms of development path, power check, interest coorination and other social conditions. In order to promote administrative examination and approval system and clean government construction, we have to set the social response as the target, put the balance between power and rights at the centre of our work, respect the law governing the administrative examination and approval and the clean government construction, and adopt a strategy of gradual reform through improving the relevant laws. The key to this approach lies in defining the boundaries of the public domain, specifying the subjects of satisfaction assessment, nurturing a mature formation of government function, and society characterized by the respect of seeking effective check on power. civil rights, promoting the transformation of government function, and seeking effective check on power.
