摘要
公平竞争权是经营者在市场竞争过程中所享有的能够自由、公平地参与竞争的权利。从分析现实案例入手,对公平竞争权存在的必要性、现实意义、救济制度等进行了分析,认为公平竞争权有利于保护经营者的合法权益,如公平竞争权被侵犯,其赔偿数额原则上应以经营者实际损失为标准来加以确定。
Rights of Fair Competition refer to the rights that enable the proprietors to compete freely and fairly in the market. Starting with an actual case, this paper analyzes the necessity, practical significance and the relief means of Rights of Fair Competition. It argues that the Rights of Fair Competition tend to protect the legal rights of proprietors. If they are violated, the amount of compensation should be measured according to the actual loss of proprietors.
