摘要
由于国际商事仲裁裁决被国际社会普遍承认与强制执行,这使得一项裁决在某一国家被撤销,却可能在其他国家获得承认与执行。通过理论及实践分析,承认与执行被撤销的仲裁裁决有其合理性,但应以撤销理由的国际标准为条件。
Because international commercial arbitral award is generally recognized and enforced in international society,this causes that an award has been revoked in one country but may be recognized and enforced in other countries.Through analyzing the theory and practice,recognizing and enforcing the revoked arbitral award has its own rationale,but it should take the reasons for withdrawal according to international standards as a condition.
