摘要
随着我国经济的快速发展及城市化进程的迅猛推进,侵犯农村妇女土地承包经营权的现象日益严重。本文通过对各种侵权现象的实证考察进而得出结论,认为相关立法与司法实践中性别意识的缺失、村民组织的不守法、权利救济渠道的"堵塞"等是造成妇女土地承包经营权遭受侵害的主要原因。切实树立以人为本的立法理念、实施严格法治、疏通权利救济渠道是保障妇女土地承包经营权的根本途径。
With China＇s rapid economic development and accelerating urbanization,the phenomenon of violating rural women＇s land contractual management rights is becoming increasingly serious.Through positive analysis,the paper draws a conclusion from various infringements.It＇s found that the lack of gender awareness in the relevant legislation and judicial practice,the village committee＇s not abiding by the law and the blockage of the right relief channels can account for the violation of rural women＇s land contractual management rights.Adopting the people-oriented concept,implementing strict rules of law and clearing the right relief chennels are the fundamental approaches to the guarantee of rural women＇s land contractual management rights.
