摘要
透视银行与客户之间的法律关系是了解银行交易法的一个重要窗口,同时也是维护客户权益及防范银行或然性法律风险的有力保障。我国在该问题的认知上仍存在许多灰色区域,如法则对存款人存款权属的规定、客户的认证、银行所负的保密义务与信息披露义务的冲突与协调及现行的银行行政处罚权等。在金融法治化进程中,这一切都需要我国的法律规则予以澄清。因此,对我国银行与客户之间法律关系的本质进行重新定位不仅具有较好的学理意义,而且更具实用价值。
To understand Bank Transaction Act, protect customer interests, and keep away banks' possible risks, it is necessary to deeply analyze the legal relationship between Banks and their customers. However, the perception on some issues are blur, such as the ownership of the deposit, the identification of customers, the conflicts of the banks' obligation on information security and disclosure, etc. In the process of regulation of financial law, all the issues should be clarified. Therefore, the paper has its theoretical and practical value.
