摘要
财产权并不是一个简单的逻辑范畴,而更多地表现为历史的范畴。在每个历史时代,财产权以各种方式在完全不同的关系下发展着。如果关注西方资本主义国家财产权法律保护的历史变迁过程,可以清晰地看到,随着社会经济的发展,法律对私有财产权的态度已在逐步地由侧重于绝对保护向相对保护转型。而社会主义的中国对于私有财产权的法律保护则走过了一条迥然不同的道路。
The property right isn＇t a simple logic category,but shows as historical category more. In each times property right develops with all kinds of mode under the different relations. Paying attention to the historical change process to protect property right by law in western capitalist countries, we may see clearly, along with the development of society and economic the attitude of law to private property right is transforming form absolute protection to relative protection. However, as a socialistic country China goes across a different way to protect private property right by law.
