摘要
土地租赁是各国在实现土地所有权和利用权在经济性上的分离所普遍采用的方式,但是由于初期我国在制度设计上主要采用的是土地使用权出让和划拨的方式,因此,有关土地租赁的方式虽然近年来已经开始实施,但是,它毕竟还是一种新的制度,有关租赁与出让的关系、适用的范围、租金、期限、土地租赁权的转让和转租以及地上改良物的补偿等问题均存在值得探讨的问题。本文试就这些方面作些分析。
Land tenancy is actually a common method adopted by every country to economically achieve the separation of the right to ownership of land from land-use right. However, due to China's main adoption of grant and allocation in the preliminary stage when the law was first made, land tenancy is still a new system in China, although it has been several years since the method was adopted. Accordingly, it is worthwhile for us to explore such issues as the relationship between tenancy and grant, the applicable scope of tenancy, rent, the term of tenure, the transfer and the sublease of leasehold, the compensation for the improvement of the premises, etc. all of which are discussed in the article.
