摘要
采矿权是准物权或特许物权,这两种目前没有质疑过的传统采矿权物权模式,是行政机关“寻租”,国有资产大量流失的秘密通道。通过对传统采矿权的物权分析得出,采矿权属于完全物权。以此改造和构筑现代采矿权物权模式,为科学建立采矿权流转市场和坚持可持续发展战略提供另一思路。
The mining right belongs to a kind of comparative real right or authorized right. It has become a secret channel of the enormous losing of state-owned capital. The mining right belongs to the perfect real right, which supplies another thinking for the reform in the scientific establishment of circulation of mining right.
